Does the LDS assume liability if shared data infringe third-party rights or breach data protection principles?

Each provider is responsible for the data assets offered in the LDS marketplace.

Upon joining, data providers are committed to accepting the LDS terms of service and are entitled to offer data products only if they are under full ownership of (or include clear distribution rights to) the stakeholder who is publishing the offer. However, the LDS Governance Body will not monitor all data assets.

At a later stage, there will be guidance and support in line with the LDS to help the stakeholders to keep their data assets in line with European rules, but primary liability remains with the participant who shares the data through the LDS.

The LDS disclaims responsibility except where it acts as controller for central component functions.
